A personal injury law case may be a particularly complex matter to pursue. Many of these injuries can occur in situations where the damage is being recorded in some way. From traffic and security cameras to police photos, or even the chance of a bystander witness with their own personal footage, you can use this evidence to show how the injuries occurred and whose fault they were. This sort of proof is relatively uncommon, so it’s important to make sure it’s available and secured if you have access to it.

Safety and Negligence

If you were in a situation where your injuries were caused by a malfunctioning product or unsafe conditions, then you have to prove that the malfunction or the conditions were the direct cause of the damage. For instance, a new car with a faulty engine that soon catches fire isn’t your fault. Similarly, it isn’t your fault if you’re expected to use broken equipment or work in a dangerous location. Evidence of these types of circumstances are the key to a successful outcome.

Intentional Damage

Most personal injury claims only require negligence, intent is not important.  However, some claims require you to prove intent. It can be hard to prove someone’s intent to cause harm, but there are still ways to do it. For example, if the other party was caught in the act or if your injuries were all defensive, then you can prove that the damages were caused by a deliberate act. Recorded threats, eyewitnesses, and a story that lines up with the injuries can all also come in handy.
