As it pertains to this situation, DUII is defined as driving while mental and physical facilities are altered by an intoxicating substance. A driver can receive a DUII conviction after:<\/p>\n<ul>\n<li>Driving under the influence of alcohol, marijuana, an inhalant, or another drug, or<\/li>\n<li>Driving with a blood alcohol content at or above 0.8%<\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<p><strong>Consequences for DUII in Oregon<\/strong><\/p>\n<p>&nbsp;<\/p>\n<p>Anyone convicted of DUII in Oregon is subject to a series of financial penalties, jail or community service time, and drivers\u2019 license suspensions. These penalties vary depending on whether the driver has been convicted of DUI in the past, as well as how much time has elapsed between convictions. Penalties are as follows:<\/p>\n<ul>\n<li>First offense \u2013 drivers committing a first offense DUII receive:\n<ul>\n<li>48 hours to one year in jail, or 80 hours of community service<\/li>\n<li>$1000 ($2000 if the BAC was 0.15% or more) up to $6250 fine<\/li>\n<li>1-year driver\u2019s license suspension<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<ul>\n<li>Second offense \u2013 drivers committing a second offense DUII receive:\n<ul>\n<li>48 hours up to one year in jail, or another 80 hours of community service<\/li>\n<li>$1500 ($2000 if BAC was found to be 0.15% or more) up to $6250 in fines<\/li>\n<li>2 years driver\u2019s license suspension<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<ul>\n<li>Third offense \u2013 rivers committing three or more DUII offenses receive:\n<ul>\n<li>90 days to 5 years in jail if two of the convictions were within 10 years<\/li>\n<li>$2000 in fines if the person is not imprisoned, up to $125,000 in fines if the person has committed a felony<\/li>\n<li>Permanent driver\u2019s license suspension, though the driver may apply for reinstatement after ten years<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<p><strong>Were You Injured in a Drunk or Impaired Driving Accident? <\/strong><\/p>\n<p>DUII is one of the most negligent actions an Oregon driver can take.
