(Part 2)<\/h3>\n<div class=\"byline\">Posted by <a href=\"http:\/\/info.letusfightforyou.com\/blog\/?Author=David+deVilleneuve\">David deVilleneuve<\/a> on Thu, Aug 29, 2013 @ 07:09 AM<\/div>\n<div><span style=\"font-family: Calibri;\">If a pedestrian does not have automobile insurance of his own, then the priority falls to any automobile insurance carrier of a <strong>family member<\/strong> of the pedestrian <strong>residing in the same\u00a0 household.<\/strong>\u00a0\u00a0 So, I will ask my pedestrian clients, &#8220;do you have automobile insurance?&#8221;\u00a0 If the answer is, &#8220;no.&#8221;\u00a0 The next question is,\u00a0&#8220;Do you live with any family members who have automobile insurance.&#8221; If the answer is, &#8220;yes,&#8221;\u00a0 then that automobile insurance carrier is primarily obligated to pay under the PIP portion of the policy.\u00a0 I should mention that <strong>PIP is legally required on all private party automobile liability policies sold in Oregon<\/strong>.\u00a0\u00a0 PIP is not mandatory for motorcycle policies or commercial policies.\u00a0\u00a0 They may have PIP, but it is not required.\u00a0 <\/span><span style=\"font-family: Calibri;\">However, all regular auto polices have this PIP provision, which will pay at least $15,000 towards the medical expenses the injured pedestrian, as well as a wage loss benefit.<\/span><\/div>\n<div><\/div>\n<div style=\"padding-left: 60px;\"><span style=\"font-family: Calibri;\">If the pedestrian does not reside with a family member who has auto insurance, and the pedestrian does not have their own auto policy, the next question is, &#8220;do you have health insurance benefits of any kind?&#8221;\u00a0\u00a0 If, &#8220;yes&#8221;, then that is the next obligated payer of medical expenses.\u00a0\u00a0 Or, if a PIP policy is applicable but the $15,000 benefit is exhausted, <strong>the health insurance is next in line.\u00a0<\/strong>\u00a0 In this example, &#8220;health insurance&#8221; is meant to include privately obtained health insurance, health insurance through an employer, Oregon Health Plan, or Medicare.\u00a0\u00a0\u00a0 <\/span><\/div>\n<div style=\"padding-left: 60px;\"><\/div>\n<div style=\"padding-left: 60px;\"><span style=\"font-family: Calibri;\">Often, these health insurance carriers <strong><span style=\"color: #ff0000;\">will initially deny payment<\/span><\/strong> on any medical expenses associated with an automobile\u00a0 accident.\u00a0 They do this because they are aware of the law that says they are not primary.\u00a0 They are aware that PIP typically comes first.\u00a0\u00a0 However, if the appropriate documents are provided to the health insurance company indicating that there is no applicable PIP benefits, or they have been exhausted, then the health insurance carrier will pay.<\/span><\/div>\n<div style=\"padding-left: 60px;\"><\/div>\n<div><\/div>\n<div><span style=\"font-family: Calibri;\"><strong>What if there is no health insurance?\u00a0<\/strong>\u00a0 Well, in that case, we finally look to the vehicle that caused this accident.\u00a0\u00a0 The medical benefits under the PIP of the at-fault vehicle is responsible to pay PIP benefits if the above options are not available.\u00a0\u00a0 <strong>This is unique to pedestrian accidents<\/strong>.\u00a0\u00a0 For instance, if you were a passenger in an uninsured vehicle and you were hit by another car that was at fault, under no circumstances does the law allow you to seek the PIP benefits of the at fault driver.\u00a0\u00a0 This is also true if you are on a motorcycle when hit by a bad driver.\u00a0\u00a0 The PIP of the opposing vehicle can only extend to pedestrians, (bicyclists included), if the other options don&#8217;t.<\/span><\/div>\n<div><span style=\"font-family: Calibri;\">\u00a0 <\/span><\/div>\n<div><\/div>\n<div style=\"padding-left: 30px;\"><span style=\"font-family: Calibri;\">But remember,<strong> there is also a liability damages claim.<\/strong>\u00a0 This is different than a medical bill PIP claim, (which pays regardless of fault).\u00a0\u00a0 Under the liability claim, an injured pedestrian can pursue all forms of provable damages, including medical expenses, (unless they have already been paid for by the PIP), wage loss, pain and suffering, and any other verifiable related damages.\u00a0\u00a0 These damages however, often come at the end of a case, long after medical expenses have been incurred.\u00a0 So, it is very <strong>beneficial to access PIP medical and wage benefits<\/strong> before a case settles so that medical bills get paid rather than go to collections waiting for a settlement that may not come for another bear.\u00a0\u00a0 Also, getting the PIP wage benefit early on can help the injured pedestrian with money to pay bills while waiting for the settlement.<\/span><\/div>\n<div><\/div>\n<div><span style=\"font-family: Calibri;\"><span style=\"text-decoration: underline;\"><strong>In summary<\/strong><\/span>, a pedestrian has the same legal rights to pursue an injury claim and all damages against a negligent driver.\u00a0\u00a0 Pedestrians also have additional option to pursue PIP medical benefits and wage benefits.\u00a0\u00a0 At Shlesinger &amp;
