deVilleneuve Attorneys had, for a few years, on staff a former insurance adjuster.\u00a0\u00a0 Having no love for his previous employer, the former adjuster gave us great insight into the working&#8217;s of an insurance company.\u00a0\u00a0 I will share with you\u00a0some answers to the question in the title of this post.\u00a0 I do this, not so\u00a0much as an effort to bad mouth insurance companies, but more so that you can see the &#8220;nastiness&#8221; for what it really is.\u00a0 <strong>This understanding will help you handle your\u00a0current or next personal injury related\u00a0insurance claim.<\/strong><\/span><\/div>\n<div><\/div>\n<div style=\"padding-left: 60px;\"><span style=\"font-family: Calibri;\"><span style=\"font-family: Verdana;\">Fi<\/span>rst of all, I want to clarify that an <strong>&#8220;Adjuster&#8221; is different than an &#8220;Agent.&#8221;<\/strong>\u00a0\u00a0Your insurance agent is the guy or gal that\u00a0is typically\u00a0very friendly and helpful.\u00a0 He is usually\u00a0located not far from your home and has a\u00a0nice little friendly office.\u00a0 The agent\u00a0smiles and does his\u00a0or her best to address your insurance needs and sell you insurance.\u00a0\u00a0 He gladly takes your premium check and\u00a0gives you refrigerator magnets and a coffee mug.\u00a0 It is rare that\u00a0I hear a complaint about an insurance agent.\u00a0\u00a0On the other hand, an\u00a0&#8220;adjuster&#8221; <\/span>\u00a0<span style=\"font-family: Calibri;\">is a different employee of the insurance company.\u00a0 Sometimes people think that when they are in an accident or they have an insurance claim, that they will just take the matter to their friend, the agent down the street.\u00a0 Please understand that agents do not handle claims at all.\u00a0 If you bring paper work to your agent, he will, at most, send it to an adjuster.\u00a0 <strong>Insurance companies do not want their friendly\u00a0agents handling\u00a0claims<\/strong>.<\/span><\/div>\n<div><\/div>\n<div><span style=\"font-family: Calibri;\">Before I begin to talk about adjusters and their methods, I will say that <strong>not all adjusters are the same.<\/strong>\u00a0 Some are better than others.\u00a0\u00a0 Not all insurance companies train their adjusters the same.\u00a0 About 30% of the time when I deal with an adjuster, I feel as if the adjuster is being professional and cordial.\u00a0 But, I am an attorney, and I think that generally my status causes them to treat me a little better than someone not experienced with the law.\u00a0\u00a0 I have heard countless stories about how <strong>people are treated rudely by insurance adjusters<\/strong>.\u00a0 Occasionally, the stories are positive, but most of the time, I am appalled by the story of how terrible the adjuster was treating this good person who was injured by a bad driver.\u00a0\u00a0 <\/span><\/div>\n<div><\/div>\n<div><span style=\"font-family: Calibri;\">When the claimant questions the amount, they are usually peppered with accusations to put the claimant in a defensive mode, or to make them feel guilty for making a claim, such as:\u00a0 &#8220;Don&#8217;t be so greedy,&#8221; &#8220;are you one of those people who abuse the system,&#8221; or\u00a0&#8220;you want everyone&#8217;s insurance rates to go up.&#8221;\u00a0\u00a0 Another tactic will be to make promises that they don&#8217;t keep, or simply ignore the phone calls of the claimant.\u00a0 <strong>Adjusters will lose paper work, or ignore clear evidence to support a claim<\/strong>.\u00a0 This can be very irritating.\u00a0 <\/span><\/div>\n<div><\/div>\n<div><span style=\"font-family: Calibri;\">When dealing with value of a totaled vehicle, I will hear adjusters say, &#8220;we don&#8217;t use Kelly Blue book values.&#8221;\u00a0\u00a0 It is stated in a such a way to suggest that Kelly Blue Book is not a reasonable or acceptable method to help determine a cars value. \u00a0Well, Kelly Blue Book is a very reputable and<br \/>\nprofessional company.\u00a0 Their values would likely be admissable in most courts as a valuable resource to determine a car&#8217;s value.\u00a0\u00a0I have successfully used Kelly Blue Book\u00a0in court. \u00a0Insurance companies would rather use their own evaluation methods because not so surprisingly, the values are almost always lower than Kelly Blue Book.\u00a0 <span style=\"color: #800000;\"><strong>It is manipulative to suggest to an inexperienced claimant that Kelly Blue Book is not a reasonable resource<\/strong><\/span>.<\/span><\/div>\n<div><\/div>\n<div><span style=\"font-family: Calibri;\">What can you do about these tactics?\u00a0 My recommendations are these:\u00a0 <\/span><\/div>\n<div><\/div>\n<div style=\"padding-left: 90px;\"><span style=\"color: #808000;\"><strong><span style=\"font-family: Calibri;\">1. Ignore any statements that are attempts to make you angry or are offensive, and simply continue negotiations calmly and confidently.\u00a0 <\/span><\/strong><\/span><\/div>\n<div style=\"padding-left: 90px;\"><span style=\"color: #808000;\"><strong><span style=\"font-family: Calibri;\">\u00a0<\/span><\/strong><\/span><\/div>\n<div style=\"padding-left: 90px;\"><span style=\"color: #808000;\"><strong><span style=\"font-family: Calibri;\">2.\u00a0Be sure to let the adjuster always know that you will gladly hire an attorney to pursue litigation if your evidence is not being considered.\u00a0 <\/span><\/strong><\/span><\/div>\n<div style=\"padding-left: 90px;\"><span style=\"color: #808000;\"><strong><span style=\"font-family: Calibri;\">\u00a0<\/span><\/strong><\/span><\/div>\n<div style=\"padding-left: 90px;\"><span style=\"color: #808000;\"><strong><span style=\"font-family: Calibri;\">3. Hire an attorney who is experienced with dealing with all these tactics.\u00a0 <\/span><\/strong><\/span><\/div>\n<div style=\"padding-left: 90px;\"><span style=\"color: #808000;\"><strong><span style=\"font-family: Calibri;\">\u00a0<\/span><\/strong><\/span><\/div>\n<div style=\"padding-left: 90px;\"><span style=\"font-family: Calibri;\"><span style=\"color: #808000;\"><strong>4.\u00a0 Do not be intimidated by the adjuster.\u00a0\u00a0 Support your case with evidence, be persistent, confident, and always express a desire for a fair settlement, but if it doesn&#8217;t come, you will <\/strong><\/span><span style=\"color: #808000;\"><strong>hire an attorney and go to court.\u00a0\u00a0 Make sure the insurance company realizes that their tactics will not make you back down, or walk away.\u00a0\u00a0 If you simply do not want to deal with the frustrations of the claims process, hire an experienced law firm that has a track record of going to court successfully.<\/strong>\u00a0<\/span> <\/span><\/div>\n<div style=\"padding-left: 90px;\"><\/div>\n<div style=\"padding-left: 90px;\"><\/div>\n<div><span style=\"font-family: Calibri;\">Shlesinger and deVilleneuve attorneys fights insurance companies, and we enjoy doing so.\u00a0 We know the playing field is not even when you are dealing with a large experienced company that has hundreds of lawyers and millions of dollars.\u00a0 We can level the playing field.\u00a0\u00a0 Let us fight for you.<\/span><\/div>\n<p>&nbsp;<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Why Is The Car Insurance Company So Mean And Nasty To Me?
