While there are many details and variances making each trial a little different than the next, there are four main areas of the trial phase;<\/p>\n<ol start=\"1\">\n<li>Jury Selection<\/li>\n<li>Opening Statement<\/li>\n<li>Presentation of the Evidence<\/li>\n<li>Closing Argument<\/li>\n<\/ol>\n<p align=\"center\">JURY SELECTION<\/p>\n<p>Jury Selection, also known as Voir Dire, is the opportunity for attorneys for both parties to interview members of a preselected group of people comprising the jury pool.\u00a0 The manner in which jury selection is conducted varies greatly from county to county and State to Federal courts.\u00a0 Some judges will give the lawyers generous leeway in questioning perspective jurors about their potential experiences and biases concerning matters relevant to your personal injury case.\u00a0 Other judges may assert more control over the jury selection process and severely limit the time and scope of the attorney\u2019s involvement.\u00a0 In an Oregon State civil trial, an attorney may remove a perspective juror from the jury pool in one of two ways; for cause or through a peremptory challenge.<\/p>\n<p>Challenging a juror\u00a0for cause\u00a0means that the lawyer is asking the Court to remove a juror from consideration in your personal injury case because the\u00a0juror may be so biased\u00a0against an important issue or claim in the case that s\/he will\u00a0not be able to follow the law\u00a0in deciding the case and would instead allow their own bias to dictate the outcome.\u00a0 If the judge determines that is in fact the case, s\/he will likely agree the juror is not fit to sit on this case.<\/p>\n<p>Unlike cause, a\u00a0peremptory challenge\u00a0is one that the attorney can use without revealing the reasons for the challenge and\u00a0without needing the Court\u2019s approval.\u00a0 Generally, each lawyer in a car accident case (or most civil cases) is entitled to exercise\u00a0up to three\u00a0peremptory challenges.\u00a0 This means the attorney can ask that up to three potential jurors from the pool be removed for any reason.\u00a0 While there are some rules and guidelines controlling these types of challenges, they are\u00a0generally granted as a matter of practice.<\/p>\n<p align=\"center\">OPENING STATEMENT<\/p>\n<p>As you probably have guessed, the opening statement is the\u00a0summary of the case\u00a0delivered by\u00a0the attorneys to the jury once it has been selected and sworn in.\u00a0 In a civil case, the plaintiff\u2019s\u00a0will go first in giving their opening statement followed by the defendant\u2019s attorney.\u00a0\u00a0There are countless approaches to composing an opening statement.\u00a0 And each one of those approaches has limitless variations and alternates.\u00a0 Generally, the\u00a0objective of the opening statement is to provide the jury with a preview and roadmap\u00a0of what the case is about, the evidence the attorney expects to produce during the trial and the basis for the claim.\u00a0 Many attorneys will use exhibits, models, and other visual aids\u00a0to promote their version of the case.<\/p>\n<p>&nbsp;<\/p>\n<p align=\"center\">PRESENTATION OF EVIDENCE<\/p>\n<p>After the opening statements are completed, the plaintiff\u2019s attorney will commence their case by\u00a0presenting their evidence.\u00a0 Usually, they will do this by\u00a0calling witnesses to testify. For example, if the plaintiff claims they were hurt in a car accident and required medical treatment for injuries sustained, they will need to call\u00a0witnesses who can support that claim.\u00a0 Similarly, if the defendant claims the plaintiff was at fault for the accident, they will call witnesses to corroborate that position.<\/p>\n<p>The other most common presentation of evidence is through\u00a0documents.\u00a0 The attorneys will offer evidence to the jury for their consideration by presenting them with documents or photographs.\u00a0 For example, as part of the plaintiff\u2019s case, the attorney might offer\u00a0pictures illustrating the damage to the car\u00a0in the crash or the bruising\/lacerations to the plaintiff following the accident or records, summaries, charts, graphs, and wage records.<\/p>\n<p align=\"center\">CLOSING ARGUMENT<\/p>\n<p>After all the witnesses have testified and the evidence has been offered, the time has come for the attorneys to give their closing argument. The closing argument is an opportunity for the attorney to\u00a0remind the jury of the evidence\u00a0that was presented during the trial and\u00a0fashion a\u00a0summary that supports the basis of their claim or position.\u00a0 In a particularly lengthy trial, it will be helpful for the jury to be reminded in a succinct manner of all the information that was generated during the course of the trial.\u00a0 For obvious reasons each attorney will focus on those facts, evidence and testimony which highlight their side\u2019s position.\u00a0 Also, the attorney may provide the jury with a\u00a0preview of what the judge will instruct\u00a0with regard to specific laws applicable to case at hand (e.g. rules of the road in a car accident case).<\/p>\n<p>If you have been in a car accident or other injury-causing episode, don\u2019t hesitate to contact our office.
