Medical Bills:\u00a0\u00a0Once you settle your personal injury case with the other side your case will be closed.\u00a0 Regardless of what you might think or believe or what\u00a0the other side\u00a0might have “implied”,\u00a0once your case is settled\u00a0you will\u00a0NOT\u00a0receive any additional funds\u00a0for past or future medical bills.<\/li>\n<\/ol>\n

    Therefore, it is critical that your settlement covers\u00a0all\u00a0of your past, present and future medical bills.\u00a0 This also includes any liens by your car insurance (PIP), health insurance, Medicare, or any other entity that paid any medical bills related to your car accident or personal injury claim.\u00a0 It is an unwelcomed surprise (to\u00a0put it mildly)\u00a0to discover that you owe your health insurance thousands of dollars after you have already settled your case.<\/p>\n

    1. Income\/Wage Loss: If you lost any wages or income due to an accident related disability, you must recover it at the same time you settle your claim.\u00a0 This is especially important if the accident rendered you permanently disabled and will cause you to incur future wage or income loss.\u00a0 As indicated above, once you settle your claim\u00a0it is forever closed.\u00a0 You will not be able to ask the insurance company for more compensation three years down the road because you still cannot return to work.\u00a0 This issue must be reviewed with your medical provider and included in your personal injury settlement consideration.\u00a0 It is your responsibility to contemplate your future loss and bring it up before settlement.\u00a0 The insurance company will\u00a0NOT\u00a0remind you of that.<\/li>\n

Read & Understand the Release Agreement: Once you reach an agreement with the insurance company to settle your car accident or personal injury claim they will send you a\u00a0release\u00a0agreement form\u00a0to sign.\u00a0 Sometimes the release agreement will be sent with your settlement check, other times they will send the release agreement first and the settlement check only after they receive the signed release back from you.\u00a0 The release agreement represents and formalizes the terms of the settlement.\u00a0 Make sure you review the agreement\u00a0before\u00a0you sign it and return it to the insurance company.\u00a0 If any of the terms of the agreement do not accurately represent your understanding of the settlement\u00a0STOP.\u00a0\u00a0Contact the insurance adjuster and request that corrections be made to the release agreement.\u00a0\u00a0If you are unsure, contact an attorney.\u00a0 Most personal injury\u00a0attorneys will be happy to explain the terms of the\u00a0settlement agreement to you.<\/li>\n<\/ol>\n
