But it does mean <\/span>we\u2019ll<\/span> see more foot traffic on our favorite hiking trails, burgeoning farmers\u2019 markets buzzing with <\/span>enthusiastic <\/span>locals<\/span>, and eager motorcyclists finally getting to enjoy drier and warmer weather. But f<\/span>or motorcyclists in Oregon, navigating heavy traffic can be frustrating\u2014especially when cars are inching <\/span>along<\/span> and you know your bike could easily slip between them. That maneuver, known as lane splitting<\/span> or white lining<\/span>, is legal in some states, like California. But in Oregon, lane splitting is <\/span>strictly prohibited<\/span>\u2014and <\/span>engaging in it can have serious legal and financial consequences, especially if <\/span>you’re<\/span> involved in a crash.<\/span><\/span>\u00a0<\/span><\/p>\n

What Is Lane Splitting?<\/span><\/b>\u00a0<\/span><\/h2>\n

Lane splitting refers to a motorcycle riding between lanes of slowed or stopped traffic. While it\u2019s touted by some as a way to reduce congestion and protect riders from rear-end collisions, it also increases the risk of side-impact crashes, sudden door openings, and limited driver visibility.<\/span>\u00a0<\/span><\/p>\n

Oregon\u2019s Stance on Lane Splitting<\/span><\/b>\u00a0<\/span><\/h3>\n

As of now, Oregon law does not permit lane splitting. Under Oregon Revised Statutes <\/span> 814.240<\/span><\/a>\u00a0 and traffic laws, all motor vehicles\u2014including motorcycles\u2014must remain within a single lane unless executing a legal lane change. If you’re found lane splitting, you could receive a traffic citation and be found partially or fully at fault if an accident occurs. <\/span><\/p>\n

What If You’re in a Lane Splitting Accident?<\/span><\/b>\u00a0<\/span><\/h3>\n

If you\u2019re involved in a motorcycle accident while lane splitting, the other driver may still be at fault, especially if they made an unsafe lane change or weren\u2019t paying attention. However, your role in the accident will be closely examined under Oregon\u2019s modified comparative fault rule (<\/span>ORS 31.600<\/span><\/a>). If you’re not more than 50% at fault, you can still recover damages\u2014<\/span>though they may be reduced.<\/span><\/a> In Oregon, your partial fault does not prevent you from receiving partial compensation.
